The Crossing Report

Border brief,

New Canada tariff list starts Thursday; Stellantis Canada talks still paused

The revised 50% Section 338 tariff list applies to Canadian goods entered from 12:01 a.m. ET on Oct. 30. Stellantis talks with Unifor remain paused, and Windsor Assembly is down through the week of Nov. 2.

At the border

We could not pull Tuesday-morning commercial waits in time for this brief. Before dispatching, check the live wait times for the Ambassador, Gordie Howe and Blue Water bridges, and the Niagara page for the Peace Bridge and Lewiston–Queenston. Today's search found no reported closures at those crossings or at the Sault Ste. Marie International Bridge.

The paperwork deadline this week is Thursday. The revised Section 338 list, signed Oct. 23, applies to goods entered or withdrawn from warehouse on or after 12:01 a.m. ET on Oct. 30, Canadian broker Carson International said in an Oct. 26 update. The extra duty stays at 50%, stacks on other tariffs, and still applies to goods that qualify under USMCA (CUSMA).

  • Coming off: certain plywood, paper products, machinery, refrigeration equipment, and packing crates and boxes.
  • Going on: certain cocoa powder, paints, soaps, vinyl flooring, carpets, wood and paper goods, chest freezers, valves, instruments and waste products, per Carson.

Neither update mentions published CBP filing guidance yet. Analysis: the cutoff is tied to the entry time, not the bridge crossing time. A load of newly covered goods that crosses late Wednesday but is entered after midnight may owe the duty. Brokers should confirm tariff codes against the proclamation's annexes and file entries early where they can.

Diesel

The latest federal figures we could confirm are from EIA's Oct. 19 survey: the Midwest diesel average was $6.352 a gallon, up 9.3 cents from Oct. 12, and the U.S. average was $6.276. EIA's Oct. 26 numbers had not appeared on its data page when we checked this morning.

We could not confirm this week's Ontario price or exchange rate. Check the diesel page for the Windsor comparison before deciding which side to fuel on.

What we're watching

  • Tariff lawsuit. Gellert Global Group, represented by the Liberty Justice Center, sued over the Section 338 tariffs on Oct. 20 at the Court of International Trade, seeking an end to collection and refunds. No hearing or ruling has been reported, and the proposed importer class is not certified. Analysis: keep complete entry records in case refunds are ever ordered.
  • Stellantis Canada. Unifor members voted 97.3% for a strike mandate on Oct. 17–18, but the union is not yet in a legal strike position, CBT News reported Oct. 20. Stellantis paused talks over its plan to sell the idled Brampton plant to Roshel, and Windsor production is cancelled through the week of Nov. 2. Our search found no report of talks restarting.
  • Detroit supplier. Dakkota will close its Detroit instrument-panel plant in two stages, Dec. 31 and March 31, cutting 397 jobs after losing Jeep Grand Cherokee and Dodge Durango work, per the same CBT report.
